Therefore, we take a highly responsible and careful approach to personal data protection and implement all necessary measures to ensure the security of data subjects’ privacy.

This Privacy Notice explains how the Company processes personal data of data subjects, including what personal data is collected, how it is collected and processed, how long it is stored, to whom it is disclosed, what rights data subjects have, and where to contact us regarding the exercise of these rights or other personal data-related matters.

This Privacy Notice is prepared in accordance with the following legal acts:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation – GDPR),
  • Law on Legal Protection of Personal Data of the Republic of Lithuania No. XIII-1426 (30 June 2018),
  • Law on Electronic Communications of the Republic of Lithuania No. IX-2135 (15 April 2004).

How We Collect Your Data

The way we collect your personal data depends on the services we provide or the nature of our cooperation.

We process personal data:

  • Received directly from you, for example when you submit inquiries or messages via our contact details or register for property viewings on our website;
  • Generated when you use our services, for example when you use our network and services, make phone calls, send SMS messages, browse the internet, or visit our websites;
  • Obtained from official registers when necessary to prepare a contract with you.

To Whom We Disclose Your Data

The Company engages only data processors that ensure compliance with GDPR and provide the same level of personal data protection as defined in the Company’s internal data protection policy.

We may share your personal data with the following categories of recipients:

  • Real estate sales partners engaged by the Company;
  • Professional advisors and auditors;
  • Banks, when transactions require financing;
  • Notaries, when contracts require notarisation;
  • Bailiffs, legal and/or debt collection service providers, debt purchasers, and joint debtor data register administrators;
  • Data centres, hosting, cloud, website administration, software development, IT infrastructure and communication service providers;
  • Marketing and advertising service providers;
  • Archiving, physical and/or electronic security, property management, and other business service providers;
  • Other third parties in connection with the sale, merger, acquisition, restructuring, or similar corporate changes;
  • Public authorities as required by law, including the State Tax Inspectorate, State Social Insurance Fund Board (Sodra), Centre of Registers, Employment Service, etc.;
  • Law enforcement authorities upon request or on our initiative where criminal activity is suspected, as well as courts and other dispute resolution institutions.

Transfer of Data to Third Countries

Where necessary, personal data may be transferred to third countries based on lawful data transfer mechanisms under the General Data Protection Regulation (GDPR).

How We Protect Your Data

To ensure an appropriate level of security, the Company implements suitable technical and organisational measures for personal data protection. In doing so, the Company follows ENISA guidelines, best information security practices, and recommendations issued by the State Data Protection Inspectorate (VDAI).

Your Rights

Under the GDPR, you have the following rights:

  • Right of access to your personal data;
  • Right to rectification of inaccurate or incomplete data;
  • Right to erasure (“right to be forgotten”);
  • Right to restriction of processing;
  • Right to data portability;
  • Right to object to processing;
  • Right not to be subject to automated decision-making, including profiling;
  • Right to withdraw consent at any time (e.g. unsubscribe from marketing communications).

You may refuse to provide personal data; however, in some cases it may be necessary to provide certain services, and without it we may not be able to fulfil the purposes described in this Privacy Notice.

How You Can Exercise Your Rights

You may exercise your rights by:

  • Sending a written request to email dap@homa.lt. The request must be signed with a valid electronic signature or accompanied by a notarised copy of your identity document;
  • Sending a signed request by registered post to Ozo g. 41, LT-07171 Vilnius, addressed to the Data Protection Officer, including a notarised copy of your identity document.

Your request must include your name, surname, address, and contact details, as well as a clear description of the right you wish to exercise.

We may request additional information to verify your identity in case of doubt.

We will respond within 30 calendar days. This period may be extended by up to 60 calendar days in complex cases.

We may refuse requests that are manifestly unfounded or excessive, particularly due to repetitive nature.

If you are not satisfied with the outcome, you have the right to contact the State Data Protection Inspectorate (www.vdai.lrv.lt).
